1. Acceptance of Terms

By accessing or using the Ocanom application ("App") operated by Ocanom Ltd ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the App.

2. Description of Service

Ocanom is a mobile and web application that provides real-time AI-powered video analysis using Google's Gemini AI. The App allows you to use your device's camera for intelligent object detection and alerts. Important: Ocanom does not store, record, or retain any video footage. All video processing is performed in real-time by Google's Gemini AI service.

3. Account Registration

To use certain features of the App, you must create an account:

3.1 Google Authentication

We use Google Sign-In for secure authentication. By signing in with Google, you authorize us to access your email address for account identification purposes.

3.2 Account Responsibilities

• You must provide accurate information during registration
• You are responsible for maintaining the security of your account
• You must be at least 18 years old to use the App
• You are responsible for all activities that occur under your account

4. Acceptable Use

You agree to use the App only for lawful purposes. You agree NOT to:

4.1 Prohibited Activities

• Use the App to monitor anyone without their knowledge or consent where required by law
• Record or monitor areas where individuals have a reasonable expectation of privacy
• Use the App for any illegal or unauthorized purpose
• Violate any applicable laws or regulations
• Attempt to reverse engineer, decompile, or disassemble the App
• Use the App to harass, threaten, or harm others
• Interfere with or disrupt the App or its servers

4.2 Compliance with Laws

You are solely responsible for ensuring your use of the App complies with all applicable laws and regulations in your jurisdiction, including privacy and surveillance laws. Different jurisdictions have different rules about recording and monitoring—it is your responsibility to know and follow these rules.

5. Third-Party Services

The App integrates with third-party services. By using the App, you also agree to the terms of these services:

5.1 Google Gemini AI

Video analysis is performed by Google's Gemini AI. Your video feed is sent directly to Google for real-time processing. Google's use of this data is governed by Google's Terms of Service and Privacy Policy. We have no control over and assume no responsibility for how Google processes your video data.

5.2 Google Authentication & Firebase

Authentication services are provided by Google/Firebase. Your use of Google Sign-In is subject to Google's Terms of Service.

5.3 RevenueCat (Payments)

Subscription payments are processed through RevenueCat. Your payment information is handled directly by RevenueCat and the respective app store (Apple App Store or Google Play Store). We do not store your payment card details.

5.4 Advertising

The free version of the App displays advertisements from third-party advertising networks. These networks may collect anonymous data to serve relevant ads, subject to their own privacy policies.

6. Subscriptions and Payments

Premium features are available through paid subscriptions:

6.1 Subscription Plans

• Free Plan: Basic features with advertisements
• Premium Plan: Ad-free experience with additional features
• Subscription prices and features are displayed in the App

6.2 Billing

• Subscriptions are billed through RevenueCat via the Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled before the renewal date
• Refunds are subject to the policies of the respective app store

6.3 Cancellation

You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of your current billing period.

7. Intellectual Property

The App, including its design, features, and functionality, is owned by Ocanom Ltd and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

8.1 No Warranty

• We do not warrant that the App will be uninterrupted, secure, or error-free
• AI detection features may not be 100% accurate and may produce false positives or false negatives
• The App is not intended as a replacement for professional security services or emergency response systems
• We do not guarantee any specific results from using the App

8.2 Third-Party Services

We are not responsible for the availability, accuracy, or reliability of third-party services including Google Gemini AI, Google Authentication, RevenueCat, or advertising networks.

8.3 No Data Storage

Since we do not store video data, we cannot provide recordings, playback, or evidence of any events captured by the App. The App provides real-time alerts only.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCANOM LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Property damage or personal injury
• Failure to detect or alert you to events
• False alerts or missed detections
• Actions taken or not taken based on the App's alerts
• Any damages arising from third-party services

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Ocanom Ltd from any claims, damages, losses, and expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third party's rights
• Your violation of any applicable laws
• Any content you transmit through the App

11. Termination

We may terminate or suspend your account at any time for any reason, including violation of these Terms. You may delete your account at any time through the App settings. Upon termination, your right to use the App will immediately cease.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.
